Disclaimer

This disclaimer is sent to each participant upon completion of booking and is accepted by the participant. In addition, the disclaimer must be signed on-site at the beginning of the event.

Participation in all events organized by Focus Climbing is at the participant’s own risk.

The participant expressly waives any and all claims against Focus Climbing or any acting sport climbing instructor arising from property damage, incidents, injuries, or consequential damages occurring in connection with an event organized by Focus Climbing. The participant also waives all claims against Focus Climbing or any acting sport climbing instructor in relation to the subsequent independent practice of the sport.

The participant confirms that they are physically fit for sports activities and, in case of any doubt, have consulted a physician. The participant also confirms that they meet all prerequisites specified for the event. Any deviations from the stated prerequisites must be agreed upon in writing with Focus Climbing in advance. All health risks, including those unknown to the participant, are the sole responsibility of the participant.

If, during the event, the participant’s condition changes and symptoms such as pain, dizziness, rapid heartbeat, or other changes occur, the participant is obliged to immediately inform the acting sport climbing instructor and, if necessary, discontinue participation. If participation continues, it is at the participant’s own responsibility.

Focus Climbing and the acting sport climbing instructors reserve the right to modify or cancel events due to external circumstances such as weather or conditions, as well as due to participant-related factors such as fitness, behavior, or compliance with instructions. Participants may also be excluded from the event without stating reasons. In such cases, no refund will be provided.

The participant confirms that they are insured against accidents and injuries that may occur during sport climbing activities or while traveling to and from the event. If this is not the case, participation is at the participant’s sole responsibility.

The participant confirms that they are of sound mind and not impaired by medication or intoxicating substances.

All rental equipment is regularly inspected to the best of our knowledge for functionality and safety. No claims of any kind can be made against Focus Climbing or the acting sport climbing instructor for accidents caused by defects that are not externally detectable. In the event of loss or damage to rental equipment, the participant will be charged accordingly.

Despite careful planning and experienced instructors, a residual risk in sport climbing cannot be excluded. This includes, but is not limited to, rockfall, injuries caused by falls, defects in equipment not externally detectable, hidden weaknesses in the rock, incorrect handling of equipment, improper belaying techniques, and failure to follow the instructor’s instructions.

General Terms and Conditions

Registration

Registration for courses, trips, as well as training and coaching sessions (hereinafter referred to as “event”) is legally binding via the website and connected booking portal, by email, or by telephone. By registering for an event, a contract is concluded between Focus Climbing GesbR and the participant, and the participant accepts these General Terms and Conditions.

After registration, a booking confirmation and invoice with payment deadline will be sent to the participant via email. If the booking person registers multiple participants, they are responsible for informing all participants about the contents of the Terms and Conditions, the data protection policy, and the disclaimer.

Payment

Payment for the event is made via bank transfer upon receipt of the invoice. In exceptional cases, payment in cash is possible only with prior agreement of both parties. Payment by debit or credit card on-site is not possible.

The issued invoice includes the payment deadline. If registration occurs less than 30 days before the event start, the full amount must be paid immediately upon receipt of the invoice.

The scope of services is listed on the website for each event. Any services not included and additional costs must be borne by the participant. Any indicated additional costs are for guidance only and may not reflect current prices.

Cancellation by the Participant

In case of cancellation by the participant, the following fees apply. If events are postponed by Focus Climbing GesbR or the participant, the original event start date remains the reference for cancellation deadlines.

For events in Austria:

  • Up to 21 days before the event: €25 processing fee

  • 20 to 14 days before the event: 50% of the total price

  • From 14 days before the event: 100% of the total price

For events abroad:

  • Up to 60 days before the event: €25 processing fee

  • 60 to 40 days before the event: 50% of the total price

  • From 40 days before the event: 100% of the total price

Cancellation fees for additional services not included in the event (e.g., accommodation, transport, transfers) must be borne by the participant. We strongly recommend taking out travel cancellation insurance, especially for events abroad.

Cancellation or Changes by Focus Climbing GesbR

If the minimum number of participants is not reached or if an instructor is unavailable, we reserve the right to cancel the event or reschedule it in coordination with all participants. In case of cancellation by Focus Climbing GesbR, all payments made will be fully refunded. No claims for damages arise.

Focus Climbing GesbR also reserves the right to modify events, schedules, scope of services, or locations at short notice due to weather conditions, unfavorable circumstances, or unforeseen reasons, without any entitlement to compensation.

Focus Climbing GesbR reserves the right to exclude participants from an event if they do not meet the required prerequisites. Safety concerns, consideration for other participants, or failure to follow the instructor’s instructions may also lead to exclusion. The decision lies solely with the acting instructor. In such cases, the participant is not entitled to a refund or partial refund.

Insurance

All sport climbing instructors working for Focus Climbing GesbR are covered by liability insurance through the Styrian Mountain Sports Guides Association. No additional insurance is provided for participants. Participants are responsible for obtaining travel cancellation, accident, liability, and health insurance. We strongly recommend ensuring that mountain rescue, recovery, and repatriation costs are included.

Liability

All acting sport climbing instructors are insured through the Styrian Mountain Sports Guides Association. Liability beyond the statutory framework is excluded. In particular, liability for minor negligence resulting in financial loss is excluded.

Participation is at the participant’s own risk, except where mandatory statutory liability applies.

All events involve a residual risk despite careful planning and professional supervision (including but not limited to rockfall, falls, hidden defects in equipment or protection systems, and belaying errors). By registering, the participant acknowledges this residual risk and waives any claims for damages against Focus Climbing GesbR and its instructors.

Focus Climbing GesbR and its instructors assume no liability for, in particular but not limited to, accidents, injuries, losses, personal injury, financial loss, property damage, independent actions by the participant, or failure to follow instructions.

All participants receive a disclaimer upon booking, which must be signed on-site before the event begins. Refusal to sign results in exclusion from the event without refund.

Participants acknowledge that Focus Climbing GesbR and its instructors cannot be held liable for any incidents or damages arising during the participant’s independent practice of the sport after the event.

Equipment

Rental equipment is regularly checked for proper function. If the participant notices damage or causes damage, it must be reported immediately to the instructor. Liability is excluded for consequences resulting from unreported damage.

Loss or damage to rental equipment will be charged to the participant. Liability is excluded for accidents and resulting damages caused by defects not externally detectable or improper use of equipment.

Personal equipment brought by the participant cannot be checked by the instructor, and the participant is solely responsible for its proper condition and functionality.

Data Protection

By registering for one of our events, the participant agrees—until revoked—that photos taken during the event may be used for promotional purposes (website, social media, print, etc.).
